Terms and Conditions of Sale

 

All bidders must complete a Property Tax Sale Buyer Registration form, a W-9 tax form, be at least (18) years of age and meet the legal requirements in accordance with LA RS 47:2162 which forbids the purchase of a tax sale title by any tax collector or tax assessor for the political subdivision, either directly or indirectly. All registrations will be conducted online. Each perspective bidder must complete the registration form by the close of business, Friday June 7th, 2019 12pm. This sale is “BUYERS BE AWARE”. All properties listed for sale and sold at this tax sale are offered and sold on an “as is” basis only. The Sheriff and Ex-Officio Tax Collector of Calcasieu Parish makes no warranty of any kind including Warranty of Title on the properties and improvements offered and sold. The purpose for the tax sale is to collect all unpaid taxes and/or liens due to Calcasieu Parish, City of Lake Charles, City of Sulphur, City of Westlake, City of DeQuincy, Town of Iowa and Town of Vinton as directed or permitted by LA Revised Statutes and Joint services agreements..

Bids will be accepted only during the hours of 9:00am CST and 2:30pm CST on June 11, 2019. The initial bid price will be no less than the total amount due for taxes and other charges, together with interest, penalties and expenses of sale. Any property not sold at the Tax Sale will be immediately adjudicated to the Parish of Calcasieu and/or City of Lake Charles, City of Sulphur, City of Westlake, City of DeQuincy, Town of Iowa and Town of Vinton .

You must enter a Tax Budget Amount. This is an estimate of the total amount of tax liens you wish to purchase. Regardless of the tax budget amount entered, you are not required or committed to purchase any tax liens. The tax sale system will monitor your activity and maintain a balance available. You may bid in excess of your tax budget amount.

Each parcel will be offered for sale to all bidders beginning with an opening bid of 100% undivided interest. Bidders may bid down a percentage of undivided interest in whole percentage points from 99% to 1%. Regardless of bid down interest, the successful bidder will still remit the total amount due. You will receive an email throughout the day of the tax sale informing you of the current status of your bids. If you are outbid by another bidder, you may elect to rebid with a lesser percentage of undivided interest.

Each winning bid constitutes an agreement by the winning bidder to purchase a tax sale certificate according to the terms of sale and applicable law. Any breach of said agreement by any bidder may, at the discretion of the Sheriff, result in retraction of the bid and prohibition from participation in future sales.

Once a property has been awarded to the successful bidder, the transaction is final. There are no refunds. Successful bidders must remit the total amount of back taxes, interest, and costs due to the Calcasieu Parish Sheriff’s Office Tax Division within 24 hours of the close of the Tax Sale. Payment methods accepted are electronic check, certified funds, or cash. If it is determined that the tax sale purchaser was ineligible to bid at the tax sale or if any parcel was erroneously sold, the Tax Sale Certificate shall be voided and the winning bid removed. In these instances, the certificate holder will be reimbursed the principal amount originally paid.

You are purchasing a lien on the property that is created by the taxes and/or other liens due Calcasieu Parish and/or City of Lake Charles, City of Sulphur, City of Westlake, City of DeQuincy, Town of Iowa and Town of Vinton. The tax sale certificate does not convey title to the purchaser. If the sale remains unredeemed after the statutory period, the purchaser may begin action to obtain a tax sale deed.

A tax sale purchaser is responsible for all future taxes assessed on the property until the property is redeemed. Failure to pay post-tax sale taxes may result in the property being sold at a future tax sale.

NOTICE TO MORTGAGE CREDITORS

Notice is hereby given to all parties holding mortgages, upon real estate, located in the Parish of Calcasieu, State of Louisiana, on which the taxes for the year 2018  have not been paid, that they should take appropriate action to protect their interest.

Redemptions: A redemption restores the title of the property as it was before the tax sale thereby reversing the tax sale. LA RS 47:2243 states that all redemptions shall be made through the tax collector of the appropriate political jurisdiction. All redemptions for Calcasieu Parish taxes must be conducted by the Calcasieu Parish Sheriff’s Office Tax Division. Redemptions by third parties are invalid. In accordance with the Louisiana Constitution, Article 7, Section 25(B)(1) the property sold shall be redeemable for three years after the date of recordation of the tax sale, by paying the price given, including costs, five percent penalty thereon, and interest at the rate of one percent per month until redeemed.
